Terms and Conditions

1. Scope of Application 
The following terms and conditions (T&Cs) apply to all orders placed via our online shop. 
2. Contractual Partner, Conclusion of Contract 
The purchase contract is concluded with NOVOFLEX Präzisionstechnik GmbH . The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order using the correction tools provided and explained during the ordering process. By clicking the order button, you submit a binding order for the goods in the shopping cart. Receipt of your order is confirmed by email immediately after the order is placed; this does not yet constitute acceptance of your order. We may accept your order either by sending a declaration of acceptance in a separate email or by delivering the goods within 2 days. A binding contract may also be concluded earlier as follows: - If you have chosen PayPal as your payment method, the contract is concluded at the moment you confirm the payment instruction to PayPal. The languages available for the conclusion of the contract are German and English. The contract text is not stored by us. 
3. Delivery Conditions 
Shipping costs are added to the product prices displayed. Detailed information on shipping costs is provided during the ordering process. You may also collect the goods from NOVOFLEX Präzisionstechnik GmbH, Brahmsstraße 7, 87700 Memmingen, GERMANY during the following business hours: Monday to Thursday from 9:30 am to 1:00 pm and 2:30 pm to 4:30 pm, excluding public holidays. Please notify us at least two working days in advance of your pickup so that we can prepare the goods. Payment at the pickup location is possible by debit card, credit card, and PIN. 
4. Payment 
The following payment methods are available in our shop: 
  • Cash on Delivery (COD) 
    A COD fee of €9.23 applies if you choose this payment method. 
  • Credit Card
    Your credit card will be charged when we dispatch the goods to you. 
  • PayPal 
    You pay the invoice amount via the online payment provider PayPal. To use PayPal, you must generally be registered or register with PayPal, authenticate your account, and confirm the payment instruction. Further details will be provided during the order process. Some payment methods are processed by our payment service provider, Nexi. You will be redirected to Nexi’s secure website to complete the payment process. 

5. Retention of Title 
The goods remain our property until full payment has been received. 
6. Warranty and Guarantees 
Statutory liability for defects applies. Information on any additional warranties and their exact conditions can be found with the product descriptions and on specific information pages in the shop. 
7. Liability 
We are always fully liable for claims arising from damage caused by us, our legal representatives, or agents in the following cases: 
  • Injury to life, body, or health 
  • Intentional or grossly negligent breach of duty 
  • Promises of guarantees, where agreed 

As far as the scope of the Product Liability Act applies In the event of a breach of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on which the contractual partner regularly relies (cardinal obligations), our liability for slight negligence is limited to foreseeable damage typical for the contract at the time of its conclusion. Otherwise, claims for damages are excluded. 
8. Online Dispute Resolution 
Online dispute resolution in accordance with Art. 14 (1) ODR Regulation: The European Commission provides a platform for online dispute resolution (ODR), available at http://ec.europa.eu/consumers/odr/
9. Dispute Resolution under VSBG 
Our company is not obliged under §36 (3) VSBG to provide information about participation in a dispute resolution procedure. However, we voluntarily declare that we will not participate in a dispute resolution procedure under VSBG.

Note on the Language of the Terms and Conditions
In the event of disputes or discrepancies regarding the content or interpretation of these Terms and Conditions, the German version shall prevail. The English translation is provided for informational purposes only.
